The bidding of the future Line 6-Orange of the metro will be the first public-private partnership (PPP) project in the Country to be performed under the changes promoted by the last year’s Provisional Measure (MP) 575. The concession model of the metro track is the first of a series of concessions that the State government of São Paulo plans to promote this year to ensure infrastructure investments considered of social interest, said the lieutenant governor of São Paulo Guilherme Afif Domingos, visiting the editorial office of DCI on this Tuesday (March 26).
The investments that the government plans to perform in partnership with the private sector total around $25 billion and cover the areas of transportation, sanitation, health, housing, education, prison administration, planning and management improvement. Within this package, the bidding of the line 6 of the metro and a contract for water production are already in process, involving investment of $3.95 billion and $791.4 million respectively.
According to Afif, the bidding of the line 6 is the first model that will include the modifications provided by MP 575, of August last year, which was amended to ensure the anticipation of state resources for the private sector and tax exemptions. “The State of São Paulo is in pole position at the start of this new modality,” said the lieutenant governor.
Afif said that in the previous model the special purpose entities (SPE) were burdened with taxation. “Who pays the federal tax is the state or city, which pays the consideration, because the entire tax burden is in the cost of provision of PPP. It is more a tax transfer from states and cities for the federal government,” he criticized.

In the case of the bidding of line 6, $1.97 billion will be the responsibility of the state government, with funds from BNDES and the National Treasury, and the remainder $1.97 billion will come from the private sector. According to Afif, the intention is to attract international capital to invest in the project. “The world stopped and with cash on hand. It has a major international crisis with high liquidity; [it] is money looking for opportunity. Infrastructure projects in the developed world [are] still,” the lieutenant governor argued.
He also indicated that the government should modify the notice to bid of line 6, published in January, to extend the period from 60 to 90 days and to change rules on expropriations. The goal, Afif said, is to ensure that all claims are agreed upon plea deal, avoiding legal uncertainty.
Within this new PPP model that the state government plans to implement the concessions sponsored involve the construction of Line 18-Bronze of the metro and Line 20-Pink, in addition to the intercity train network. The state also expects administrative concessions for the construction, operation and maintenance of three prisons, four hospitals, in addition to a digital inclusion project for public school teachers and an implementation project of full vehicular yard logistics.
